"The applicant’s score, when assessed in relation to the visa under Subdivision B of Division 3 of Part 2 of the Act, is not less than the score stated in the invitation to apply for the visa."
When you are invited to apply for a visa via skillselect method, the visa invitation you receive will be based on the Expression of Interest (EOI) that you originally submitted. So you will have to prove everything that you claim on your EOI that contributes to your total point score.
So use this skill select eoi tip and avoid over claiming on your skillselect EOI if you can not prove it via documentation and records, which includes work experience, qualifications and employment history that you are claiming points for.
The skillselect automatically calculates your points and you will be assessed against the points score you claimed, you will need to provide the evidence for it.
So once again in this skill select EOI tip, don't over claim when submitting your EOI, you could be banned for 3 years!
If you have worked in your industry that you have dont have proof for. Add this work experience to the "Not Relevant" to your chosen occupation. You will not be awarded points for this work, but you wont have to Prove it either.
If you have already submitted your EOI? and you were fraudulent and did over claim on the skillselect EOI. Then Save yourself a lot of heartache and login to skillselect and remove it.

Actually my case look like Sarah case . Here is my situation
Firstly i have applied for ACS assessment before 1 July 2010 (old assessment system) and i got negative assessment
and they mentioned that i did not meet six years of experience under category B and they showing my experience at this time as:
1- one year and three months (1st company)
2- 2 years and one month (second company)
3- 1 year and 2 months (3rd company)
Recently, i have applied again and I've got positive assessment but they did not mention any thing just i am
qualified as i have Microsoft certificate and also my Bachelor considered as Bachelor degree with minor in ICT.
And they showing my experiences as :
1- one year and three months (1st company)
2- 2 years and one month (second company)
3- 3 years (3rd company)
Now while i'm going to apply for EOI and state sponsorship (NSW).I do not want to mention my first company experiences
period(one year and three months).
Due to Diac Points system i need just 5 years of experience which i already meet without mention my first company experience period.
Or it will be unsuitable as ACS in my first assessment asked mt to have six years of experience.
As i see on the internet they have said that i should mention it but mark it as not relevant work in EOI …is that true? Can i do that or will not match my ACS requirement?
secondly in state sponsorship (NSW) what shall i do? don't mention it or i have to mention it too? and if i didn't mention it in state
sponsorship (NSW) form, should i remove it from my resume or what do you see?

Hi Mo7amed,
As you know the laws are changing all the time. Which makes it hard to keep up with it. Your case might be an example of seeing first hand the changing of the laws.
In regards to your question, in my opinion it all depends on if you have sufficient evidence to support your first job of 1 1/4 years. If yes i might consider including it on your EOI. As it can only help. But if you dont have the sufficent evidence there would be no point to include it in your EOI.

Kindly i want to make sure of ,while i don't have enough evidence so in this case may i remove it from both my resume as well as my EOI and state sponsorship forms although it's already mentioned in my Assessement is that possible and will not affect my case

Hi Aurelie,
It is difficult for me to advise on how to proceed. Sounds like valuable experience. You have to remember that to claim points for experience, you will need to be able to provide proof of your experience in the required form of documentation.
The more documentation you have the Better it is.

I have a problem where my acs positive skill assessment does not match my overseas work experience.
I have overseas work experience in australia that are split, which means I travelled back to India between my assignments and came back to Australia. My problem is my company does not give this break up of my overseas experience and have only given a letter based on recent assignment.
My acs assessment has only considered my recent overseas experience and have not taken into consideration my earlier ones.
I have submitted my Eoi based n my actual experiences ( not what acs had given me) . can you please advise if this will be a problem or should I go back to acs and re assess. Please help me

I think this could pose a problem in the long run, especially if your application is handled by anyone of competency,, (rareity these days).
This is really a classic case of doing the work but not collecting the recognition for it. (through no fault of your own) your stuck between what we call “A Rock and a Hard Place”.
Could you write a letter to your pervious employer asking them to confirm the period of work that they did not include on their recent letter?
If i was you, I would try and update the EOI details to reflect the the evidence that i had on file.
Its always better to be safe than sorry.

I am in a very similar situation as Mohamed.
My got my positive assessment for all my 8+ years of work ex (via employment references), but for the current employer, I am worried that if DIAC calls up to check (the contact no. provided on emp reference is of HR, and HR dept in my current company are useless so I doubt if them will be able to respond to DIAC properly if called) and i dont want to take that risk.
Moreover, without this experience I am still able to get enough points.
So should i remove it altogether from EOI (and everywhere else like resume to maintain consistency) or should I mention it but mark as not relevant to occupation code.

Sounds like you really need someone qualified to look deeply into your particular case. Self educating can often provide answers, but there is a time and a place for professionals. (Sorry im not a professional).
I would recommend that you interview at least 3-4 professionals that you believe can help you with this and moving forward. This should not cost anything. if you explain that your looking for someone to help with the entire emigrating process.
This will allow you to interview them and make them work to becoming your client.
What if for example, you knew the answer to your question. and you wanted to test the ‘Professional’ by asking them a question before making the commitment to contract with their immigration services. That way, one may think that you will get four of the same answers to your test.
You’ll also get a great feel for who you will work best with moving forward, when you do need professional service.

I am in a very similar situation as Mo7amed and would appreciate if you could provide your valuable advise.
I have recieved positive assessment for all of my 8+ years expericence with 2 employers (1 past and 1 current) by the normal route of submitting detailed employment references.
Now, my worry with current employment is that on the letter the contact details are provided are of HR dept. And HR ppl in my current company are not very competent people, and if DIAC calls them for verification I doubt if they will be able to satisfactorily answer the queries, and which will put my application to risk.
Moreover, without the current employment, I am still getting enough points on the EOI. So I am considering not to claim points for the current employment.
I would like advise on how to do that i.e. should I not mention it in the EOI (and everywhere else to maintain consistency) or should I mention it by mark it not relevant to occupation code.
It is to be kept in mind that this experiece is mentioned as suitable in the assessment letter.

Sounds like the solution lays with contacting the HR department of your current employment and updating them on the EOI you have submitted and just varify with them your details, encase they recieve a call regarding your EOI
Herein lays the benefit of being able to Quickly build Report with anyone, as this will help you make friends in higher places so to speak.
Do you think it would be possible to talk to or email your HR department with your upto date record and inform them of your EOI intentions?
Again, think about it, they are only “incompetent” as you say, because they have not received the right information (coaching from you) regarding queries on your EOI.

I am wondering if you could help me as I have spent the last couple of days searching for answers to no avail.
Our case is as follows, I have submitted the EOI yesterday, but I am confused by one question, the employment section. My husband has 8+ years experience in 4 companies starting Nov 2004 (after graduating from University with a Bachelor Degree), and all can be proved. the ACS result letter was positive but considers employment after Nov 2006 to equate to work at an apporpriately skilled level, which leaves him with 6+ years of experience. (the same happened with my assessment)
Now I am confused as to what to enter in the EOI, should I include all employement from 2004 (which gives me points and can be proved by documents) or should I enter what ACS considers – that is, only after 2006 hence losing 2 years and losing points – and expressing the years before as not relevant?? is this considered over claiming even if all documents are available?
